Does anyone here do some canoeing and the like, I've done some in the past and recently not the rapid stuff but just gentle stuff.

So been watching this case, seems not a criminal offence

What are the "facilities" he was using other than the natural flow of the river and geological location itself?
If he just uses a section of river as he paddles past then I would be in his favour. I do not like tolls, but I do accept things like bridges and roads need paying for and require upkeep....but toll on a RIVER?
If he uses their slip way, parking , canoe salom or what ever goodies they provide then I would expect him to pay up fair and square.

Totally agree.. If he is just using the river then it should be thrown out.. if there are facilities he is using that are taken car of by the club he should pay!

From other news reports and what others have said he was just passing along the river and not attempting to land on the bank.

However some outward bound centre has decided to charge passing canoes £2-£3 to pass though so you are ment to stop get out pay the bloke and carry on.

Some angleing clubs and other landowners can get right nasty if you canoe down a river past there land, other areas there is no problem.

Its the fact he was proscuted by the plods ie a crimminal offence for not paying ie thief charge now the CPS have dropped it but you still can face a "civil trespass"

Technically the only river that is "free" in the UK is the Severn, all other rivers are actually administered by the Environment Agency and a licence is payable for their use, which is why boats have to pay a fee on the Thames, and the Broads. The licence applies to ALL vessels, even canoes.
How this Company can say they "own" the water I do not understand.

Does the company pay a council or other body for their use. I guess if so then they may have a point. However if someone does pay and then has any kind of accident or cold or illness through contact with 'their' water he could sue them. One could go along, pay, then demand to see their insurance certificates etc covering the use of their facilities.

Almost all river and lake beds in the UK are owned by somebody. Usually the person owning the bank owns to the middle of the body of water, while they don't own the water they do, unless rights of navigation exist, have the right of control over all activities on the water, whether fishing, canoeing, swimming or anything else.

Rights of navigation can be granted by the landowner, by the government or by ancient rights, if these rights do not exist any form of navigation is as the law stands trespass.

There is a campaign by the canoeist to get all navigable rivers opened up to navigation I am afraid as a land owner I feel this falls into the same category as the Open Access for the ramblers etc, if they want access they should pay towards maintenance etc.

I think there is a "tidal limit".

Many "bed" owners allow reasonable recreational use where it does not conflict with their own use etc and don't forget public organisations can be owners.
